Compliance

Compliance is the need for a company to establish adequate procedures to ensure that managers, employees and other related agents comply with current regulations. Compliance risk is the risk of sanctions or reputational damage for non-compliance with the regulatory framework (which includes not only laws but also corporate policies and codes of conduct).

It is, therefore, a risk to be taken into account, which, along with other types of risks, companies in any sector face when carrying out their business activities.

Legal persons can be charged/investigated and convicted for the commission of an offence (Art. 31 bis PC). For this to be the case, the legal person must be capable of committing offences through its legal representatives, de jure or de facto administrators and employees.
