Since the end of the 1980s, a new business model has been consolidating in Spain based on the concession of exploitation rights for a product, activity or commercial name, granted by a company to one or several people, known as FRANCHISING. The foundations of this legal business are based on the franchise contract where not only the relationship between franchisor and franchisee comes into play, but also three essential elements: the use of the brand, the know-how, and the ongoing support between both parties. The complexity of this matter lies not only in the regulatory framework itself, but also in the network of actors involved, such as, among others, the companies normally approved by the franchisor, such as engineering firms, construction companies, architects, suppliers, etc., without forgetting another essential element for the implementation of a franchise: the relationship with the different administrations, e.g. the controversial issue of the granting of planning permission prior to start-up.
